<p>Criminal penalties for infringement can result in prison time and hefty monetary fines.</p>
<p>The three most common types of infringement are copyright infringement, patent infringement and trademark infringement.</p>
<p><strong>Copyright Infringement</strong><br />
Copyright Infringement occurs when a copyright holder’s creative work is unjustly reproduced and/or distributed.</p>
<p>The eight types of creative work protected under copyright law are literary works, musical works, dramatic works, choreographic works, pictorial/graphical/sculptured works, motion picture works, sound recordings, and architectural works.</p>
<p>Since not all expressions are protected, it’s important to know what is included in copyright law before claiming infringement.  The copyright statutes can be found in their entirety in Title 17 of the United States Code.</p>
<p>Copyright owners have the exclusive rights to their work and are the only persons allowed to reproduce the work, make derivative works from the original work, distribute the work, display or perform the work.  Terms for copyright can vary depending on when the work was created, and when the given term expires, the work passes into the public domain where it can be used without permission from the copyright holder.</p>
<p>Penalties for copyright infringement include hefty fines, attorney’s fees, and possible jail time.  To avoid copyright infringement, obtain work legally by means of fair use and avoid any willful infringement.</p>
<p>If suspected of copyright infringement, it will be necessary to hire a copyright law attorney to defend your case.</p>
<p><strong>Patent Infringement</strong><br />
Patent infringement refers to the unauthorized making or distributing of any protected patented invention within the United States.</p>
<p>Patent infringement can take the form of being direct, indirect, or contributory.  Penalties for patent infringement depend on the severity of the involvement.</p>
<p>A direct infringer is someone who makes, uses, or sells a patented invention. Indirect or contributory infringers are those that knowingly sell, supply, or encourage the use of a patented item.</p>
<p>While patent infringement does not result in jail time, infringers can be sued by the patent holder.  Resulting penalties include paying for damages to the patent holder if they should win the case, court-ordered prohibition against using or selling the patented invention, attorney’s fees and court costs.</p>
<p><strong>Trademark Infringement</strong><br />
Trademark infringement occurs when an infringer uses a mark that creates a likelihood-of-confusion with a mark that is protected under trademark right.</p>
<p>When suing for trademark infringement, the plaintiff must show that they own rights to the mark and that the defendant has used a confusingly similar mark to create a likelihood-of-confusion and deception with the consuming public.  Courts look at factors for likelihood of confusion such as the similarity in the overall impression created by the two marks, the strength of the original mark, and the degree of care by the consumer.</p>
<p>The most common penalty for trademark infringement is injunctive relief, but monetary damages are also sometimes collected.  Additionally, the defendant will need to pay possible court costs and attorney fees.</p>

<p>In most cases, common sense will tell you that one driver, motorcyclist, or pedestrian acted carelessly and is therefore at fault for the accident. </p>
<p>However, there may be some extenuating circumstances that will affect the way an insurance company, or even a court, will view who is at fault. </p>
<p><span id="more-395"></span><!--more--></p>
<p>After an accident occurs, it is important to carefully review what happened at the accident scene.  </p>
<p>As the victim of an accident, you will want to look for ways to prove that the other person or party was at fault.  Three general ways to determine who is at fault are:  obtaining police reports, reviewing state and local traffic laws, and the nature of the accident. </p>
<p><b>Police Reports</b><br />
Any officer responding to the scene of the accident will file a police report.  If it’s obvious who is at fault, the police officer may state in the police report that one person violated a traffic law and is therefore at fault.  The officer may cite that careless driving was involved in causing the accident, further proving who is at fault.  These police reports are a valuable resource in proving fault.</p>
<p><b>State and Local Traffic Laws</b><br />
By reviewing state and local traffic laws, you may be able to find additional support to prove who is at fault in the accident.  </p>
<p>Often known as the vehicle code, and more casually as “The Rules of The Road,” these state and local laws help determine who was in the wrong in given situations.  If any of these rules apply to your accident, make sure to note it for reference when dealing with your insurance agency. </p>
<p>Common rules involving vehicle code include speed limits, “right of way” statutes, and roadway markings. These laws can sometimes be found at a local police office, and can always be found at local libraries or law libraries. </p>
<p><b>Nature of the Accident</b><br />
When involved in certain types of accidents, the other driver is almost always at fault.  In these certain types of accidents, the driver causing the accident has “no-doubt” liability.”  Insurance companies rarely bother arguing about the following types of accidents because of “no-doubt” liability:</p>
<p><b>Rear-End Collisions:</b><br />
If you are hit from behind while driving, it is rarely ever your fault. Regardless of why you stopped, the basic rules of the road require all drivers to be able to stop safely if traffic is stopped. </p>
<p>The damages from the accident will prove that it was a rear-end collision because the car that struck you will have front-end damage, and you will have rear-end damage. The driver that hit you may be able to file a claim against someone who caused you to stop suddenly, or a third party car behind them that pushed their car into yours, but that still does not change the fact that they are responsible for hitting your car and any injuries or damages that occurred from the accident. </p>
<p>Also keep in mind that your own carelessness may reduce the amount of compensation that you get from the accident.  If your taillights were out and the car behind you couldn’t clearly see that you were stopped, this can be considered “comparative negligence” and you may not get as much compensation for any injuries or damages. </p>
<p><b>Left-Turn Accidents:</b><br />
In almost every incident involving one car going straight down the road and another car making a left turn, the car making the left turn is at fault if an accident occurs. The damages to the cars will be a key indicator that a left-turn accident occurred – one car will have front-end damage and the other will have front-right side damage.</p>
<p>Exceptions to this rule are only made if the car traveling straight was going considerably over the speed limit or violated a major traffic law, such as running a red light. </p>

<p>To protect yourself from buying a lemon and incurring expensive mechanical problem, know the complete history of the car you are purchasing.<br />
Auto Fraud comes in many faces including odometer rollbacks, resale of undisclosed salvaged or flood-damaged vehicles, and switch and bait advertising. </p>

<p><b>Take these steps to ensure that you will not be a victim of auto fraud:</b></p>
<p><b>Have the Car Checked by a Mechanic</b><br />
If possible, take the car out for a drive on a variety of road conditions including highways, curvy roads, and hills. Test all the features of the car – brakes, steering, air conditioning and heat, and gauges. Stop at a local mechanic to have him look under the hood for any obvious defects. </p>
<p><b>Finance Through Your Bank</b><br />
Banks typically offer lower financing than a car dealership.  Check with your bank before car shopping to see if they will approve you for financing. </p>
<p>Car dealerships make a profit when they can get you to finance our car through them.  By securing a loan from your bank for the amount you can afford to spend, you’ll also be able to set a spending limit when negotiating a price with the car dealership.</p>
<p><b>Read The Warranty</b><br />
While the big print on warranties may be enticing, it’s worth the time to read the entire warranty before signing on the dotted line. </p>
<p>Many used car dealers will provide you with a deal warranty, which may state in small print that “wear and tear” is not included in the warranty.  Car dealers can then refer to this statement when a mechanical problem arises to get out of covering any problems. </p>
<p>Make sure that you are clear on what the warranty covers and if necessary, ask for more specifics or minor changes to the warranty.  Get a signed copy of any amended warranty for your records. </p>
<p><b>Don’t Rush Into Buying</b><br />
Avoid impulse buying by standing your ground and not letting a salesman talk to you into a quick purchase. Salesman typically work on commission, and therefore their goal is to make a sale. It will benefit you in the long-run to take your time and research the car and the warranty before purchasing. </p>

<p>Patients were informed that they might require a revision surgery &#8212; a surgery which removes the defective implant and replaces it with an implant of a different design.</p>
<p><span id="more-2014"></span></p>
<p>Artificial hip implants were first developed in the 1940s and allowed patients with degenerative hip disease, osteoarthritis, or injury to enjoy an active lifestyle.   In the mid-1970s, the hip implant design was refined and consisted of stainless steel femoral stem and head, a polyethylene component and acrylic bone cement.</p>
<p><font size="3" color="#003366"><b>Implant Innovation</b></font> </p>
<p>In 2005, DePuy came to the market with a new hip implant design, the ASR XL Acetabular and Hip Resurfacing systems, which they marketed to active and younger patients. This new design was approved by the FDA under rule 510 which is a &#8220;fast pass&#8221; system, allowing medical devices to be approved without undergoing rigorous clinical trials. This design was a departure from other designs as it hadmetal-on-metal components.</p>
<p><font size="3" color="#003366"><b>Health Problems</b></font> </p>
<p>By 2008, complaints started coming in from patients with DePuy artificial hips because of a high rate of failure of the device.  Patients, who expected at least a 15 year life-span for their hips, started experiencing symptoms of severe pain, fractures, loosening, and dislocation.  </p>
<p>As worrisome as these symptoms were, reports of other serious symptoms started coming in. Specifically, some patients were diagnosed with metallosis or cobalt/chromium poisoning which was caused when the metal components of the hip implant rubbed against each other and shed metal debris into patient’s blood stream and surrounding tissue. Some of these patients were diagnosed with pseudo-tumors, tissue necrosis (death) and other symptoms of heavy metal poisoning. </p>
<p><font size="3" color="#003366"><b>Product Recall</b></font> </p>
<p>DePuy issued a recall of the hip implant systems in August of 2010 in the United States. However, this was several years after studies in Australia, Sweden and the UK were showing between a 8-13% failure rate of the devices and the hip implants were banned in those countries.</p>
<p>While DePuy Orthopaedics has promised to pay the medical costs of patients for their ongoing medical care and hip revision surgeries, DePuy does not compensate patients for other non-medical costs such as loss of wages, loss of an active lifestyle, and for pain and suffering. Therefore, many patients are seeking compensation through litigation. Claims against DePuy may result in compensation for these other costs.</p>

<p>Fair use is normally brought up when discussing commentary and criticism of a copyrighted work.  Although there are no clear, definitive terms for fair use, courts have regarded some activities as generally included within the spectrum of fair use. </p>
<p><b>These activities include:</b><br />
Reviews of works, use in educational settings, quoting in news articles, parodies of works, and reproduction of a work for judicial proceedings.</p>
<p>Laws governing fair use are open to interpretation in court cases stemming from debate over what does and does not qualify for fair use.  There is no way to guarantee that an activity will or will not qualify as fair use because each user and copyright owner may have a different opinion of what qualifies. </p>
<p>Legal problems usually arise from the activity in question causing the copyright owner to lose money, or from the activity offending the copyright owner.  Lawsuits stemming from these issues are usually brought to court for a determination on fair use to be made. </p>
