Public vs. Private Attorneys

Differences between public and private defenders? No doubt there is salary difference, with private attorneys earning more. However, public attorneys get trial experience more quickly. Moreover. public Attorneys have a better opportunity to learn and be mentored. Also there can be a big difference in the resources available to handling cases. In some cases private attorneys have the advantage (think clients with deep pockets) while in other cases public attorneys have the advantage (think prosecutors who have a distinct advantage given the pubic resources). Depending on the public office the public attorney may more access to important tools, such as investigators (police). However, private attorneys will usually have an unlimited time and perhaps resources to spend on any client. Public attorneys tend to have larger caseloads resulting in less time to spend on any individual client's case. That is a very real disadvantage. It is important to understand that the pay difference between a public and private attorneys does not necessarily reflect on the quality of service a public attorney provides. In fact, many public attorneys are very committed to their jobs. Accordingly , they are willingly to accept a lower salary to provide an important service to the public. Lastly public Attorneys typically can’t refuse cases unless there is a conflict of interest. However, a private Attorney can refuse cases for almost any reason . Often private attorneys will refuse case because the client can not afford the fee or the case isn't very strong.

Insurance and the court system

This a very complicated question. A legal thome could be written addressing these important issues. Everyone should check their insurance coverage and policy language carefully. Remember if you don't pay a premium you don't have coverage. Also read the disclaimers, so there are no surprises when an accident happens. Insurance covers for negligent conduct but usually not intentional conduct. As regards auto insurance some states have no fault insurance. Other states have quasi no fault insurance. And other states have only fault insurance. In Massachusetts physician's try to avoid workers comp, Medicare an Medicaid insurance as the compensation rates are low.

Knowing When to Settle

Settlement occurs for several reasons. A settlement may be reached because a defendant realizes that settling a case will be less expensive than going to trial. Also plaintiff may be encouraged to settle a case for less than it is worth because the defendant does not have the financial ability to pay a judgment. In fact a judgment may force the defendant into bankruptcy leaving plaintiff with nothing. A settlement is possible when both plaintiff and defendant realize that hey have imperfect cases. The plaintiff's case isn't as strong as once thought and the defendant realizes that the defenses are no longer a slam dunk. Solution - negotiate a settlement. Also settlement often occurs when one party or both parties tire of the litigation. Given the docket backlog, cases can languish in the courts for years while the legal costs mount. Settlement can also be encouraged by the history of particular trial judge or a jury in a geographic area. Hence the term forum shopping! A settlement removes the risk of an adverse outcome. By going to trial one is rolling the dice. A settlement provides a guaranteed outcome. In some cases the parties may be so intransigent that the case must go to trial. I tried a personal injury case to a jury where the defendant (insurance company offered $5,000 against $25,000 in medical bills. The trial judge suggested the case settle for $00,000. The insurance company increased its offer from $5,000 to $7,000. The case went to trial and the jury returned a verdict of $210,000! How often do my cases end in settlements? 95%

When You Can’t Afford A Lawyer

My law office offers payment plans for our legal services. These plans call for the client to make progress payments. As each progress payment is made, additional legal work is performed. Also, in special situations my office will charge a sliding fee based a person's assets and income. The Massachusetts Bar Association encourages pro bono legal services for people are indigent or nearly indigent. Annually my office provides pro bono services to people who truly can not afford top pay for our legal service. These clients are referred to my office by social agencies who have already determined their inability to pay for legal services. To keep legal fees manageable, I will utilize a paralegal who works at a lower rate. Legal services can be financed via charge card. We are noticing that more people are using charge cards to pay for legal services. Lastly my office offers flat fees allowing the consumer to choose the type of legal services he or she desires. All fees are disclosed in a fee agreement which the client reads and signs before work begins.
