Indecent Exposure

Indecent exposure occurs when someone exposes his or her genitals in public.  The intent is that the offender will derive some sort of sexual pleasure or gratification from the act and cause onlookers to become horrified and deeply offended.  Indecent exposure may be thought of as the “flasher” who exposes himself in the neighborhood.  It is a sexual crime, however indecent exposure doesn’t involve physical contact.  If the offender makes physical contact with a victim, the charge would become sexual assault, not indecent exposure.

Sometimes minors are charged with indecent exposure and are faced with serious consequences for acts that they never thought of as sexual.   A good example of this is the college student who gets drunk and moons someone.   He or she could be arrested and charged with indecent exposure and would be very distressed over the thought of having a sexual offense charge on his or her record.  It would be very important for him or her to seek the advice and counsel of an experienced criminal defense attorney who could get the charge plea-bargained to something less severe, such as disorderly conduct.  You should seek an evaluation of your case with a qualified criminal defense attorney as soon as possible.

In other situations, these cases are charged due to entrapment.  Many states vary on the nature of these sexual violations, but often the laws are very old and do not make provision for homosexual men or women to display any behavior in public.  If a homosexual couple is seen kissing in certain states, they may be charged with a crime.

Indecent exposure may often lead to additional charges, such as lewd and lascivious behavior.  This is especially true if the exposure involved sex between to people in a public place, and where onlookers were present.  If you have been charged with indecent exposure, lewd and lasciviousness behavior, or sexual assault you should make sure that the criminal defense attorney that you contact is experienced with handling these types of cases.
