The role of a divorce lawyer is to act as a mediator in settlement of divorce outside of court or to represent a client in court proceedings if there is any judicial involvement. Divorce attorneys will meet with an individual to conduct preliminary research into the potential divorce case and determine if there are valid grounds for divorce. If there are valid grounds for divorce, the divorce attorney will handle the proceedings either in court or during settlement.

Divorce lawyers take any necessary action involving the court on behalf of their clients, including filing a summons and complaint, response to the claims against his or her spouse, and representation in a contested divorce. If a divorce can be handled outside of court, a divorce attorney will oversee the settlement of divorce by resolving matters pertaining to division of assets, child custody and support, and spousal support.
