The foreclosure process occurs when the bank or other lender attempts to sell or repossess tangible, "immovable property" due to the borrower's failure to comply with the mortgage agreement. In the United State there are two types of foreclosure: Judicial foreclosure and Nonjudicial foreclosure. In a Judicial foreclosure, the lender must sue the mortgagor in state court. A Nonjudicial foreclosure does not require that a lawsuit be filed. The lender can issue a Notice of Default (NOD) to make the borrower aware that there is intent to sell the property.
